“For God so loved the world, that he gave his only Son, that whoever believes in him should not perish but have eternal life.” — John 3:16 (ESV)

Legal Recruiter Fees: How Contingent, Pay-on-Start Search Works for Law Firms

The short answer: The hiring law firm or company pays the legal recruiter. Candidates never pay. At Whitton Recruiting (WR), legal searches are contingent with no upfront recruiting fee: you pay when your hire starts. WR's fee is 20%, 22%, or 25% of the hired candidate's first-year salary, depending on the protection you choose.

Who pays a legal recruiter?

The employer pays. When a recruiter places an attorney, paralegal, or in-house lawyer, the hiring firm or company pays the placement fee. The candidate does not receive an invoice and does not owe anything.

Whitton Recruiting legal fees

WR recruits attorneys, paralegals, and legal support professionals for law firms and legal teams. Choose the protection that fits.

All fees are a percentage of the hired candidate's first-year salary. No upfront recruiting fee. Pay when your hire starts.

Option 25% of first-year salary 22% of first-year salary 20% of first-year salary
Protection 6-month guarantee 90-day guarantee 60-day replacement
Refund by departure Month 1: full refund; Month 2: 5/6; Month 3: 4/6; Month 4: 3/6; Month 5: 2/6; Month 6: 1/6 Days 1-30: full refund; Days 31-60: 2/3; Days 61-90: 1/3 Replacement only: one-time replacement search. No cash refund or credit.

Your choice when a hire does not work out

For the 22% and 25% options, choose at the time of the incident: the eligible cash refund or a credit toward your next hire equal to that refund + 10%. Example: $10,000 eligible refund OR $11,000 credit. Refunds are based on the placement fee.

Guarantee essentials

Qualifying resignations or terminations only; layoffs excluded. Pay in full and on time and report departures within 10 calendar days of the last day worked. Replacement service or unused credit can be voided for lack of cooperation, failure to interview within 14 calendar days of presentation, or no reply/feedback within 5 calendar days after email contact attempts.

Summary only; the signed fee agreement controls.

How legal recruiter fees are calculated across the industry

A percentage of first-year compensation

Most permanent legal placement fees are a percentage of the hire's first-year compensation. For context only, not WR's terms: Lateral Link describes a common range of 20 to 33 percent of first-year compensation, and LawMates points to NALP's Lateral Hiring Best Practices Guide, which describes the industry standard search firm fee as 25 percent of a placed lawyer's guaranteed base compensation.

Know what the percentage applies to

Agreements may count base salary only, salary plus a guaranteed bonus, or total compensation. WR's fees are a percentage of the hired candidate's first-year salary.

What moves the number

  • The protection you choose
  • Seniority of the role and how scarce the practice experience is
  • The market and location

Contingency vs. retained legal search

Contingent search Retained search
When you pay When a hire is made (at WR, when your hire starts) Part of the fee at engagement, regardless of outcome
Upfront cost None A retainer
Exclusivity Varies by agreement Exclusive mandate
If no one is hired You owe nothing The retainer is typically kept
Often used for Associates, counsel, legal support, many in-house roles Partner moves, confidential or highly specialized searches

For a deeper comparison, read contingency vs. retained legal search page.

When is the fee paid?

Practice varies. Some recruiters invoice on an accepted offer, some split payment into installments, and retained firms collect part of the fee upfront. With Whitton Recruiting, you pay when your hire starts.

What replacement protection should cover

A guarantee is only useful if you know its length and conditions in advance. With WR, the 25% option carries a 6-month guarantee, the 22% option a 90-day guarantee, and the 20% option a 60-day one-time replacement search. We check in during the protection period to help address issues early.

What you should get for the fee

A fee should buy more than a stack of résumés. With WR, every introduction comes with a considered candidate presentation and résumé, so you know why the person fits, what they are looking for, and when they can meet. Candidates are interviewed, screened against your role, and aligned on compensation.

  • Credential checks: For attorneys, we review bar standing and disciplinary records. We can also coordinate references and relevant credential checks.
  • Weekly visibility: A dedicated account manager checks in with you. Every Friday, you receive your candidate pipeline, interview stages, and next actions.
  • Candidate follow-through: We touch base with candidates every 48 hours or less, share feedback, and help schedule interviews.

Questions to ask before you sign a recruiter fee agreement

  1. Is the search contingent or retained?
  2. When exactly is the fee due: on offer, on start, or in installments?
  3. What compensation is the fee based on?
  4. How long does replacement protection last, and what are the conditions?
  5. How will you report progress, and how often?
  6. What screening happens before I see a candidate?
  7. Do you check bar standing and disciplinary history?

How a WR legal search works

  1. Set the target. Align on practice area, experience, jurisdiction, team needs, compensation, and timeline before the search begins.
  2. Meet screened candidates. We interview legal candidates. You receive a résumé and presentation covering experience, motivation, compensation, and availability.
  3. Get to the start date. We coordinate interviews, collect feedback, and support offers, start dates, and the transition into your firm or legal team.

First qualified candidates, typically in 48 hours after completed intake and a signed agreement. Specialized and senior searches may take longer.

Example placements

Intake Attorney, Richard Harris Law (Las Vegas, Nevada). $125,000 annual salary. We placed an attorney with long-term litigation ambitions into an intake role at a growing personal injury firm. Within 90 days, the attorney moved into litigation after helping the firm restructure intake responsibilities, compensation, and team structure.

Director of Litigation, Dimopoulos Law Firm. $200,000 base salary. The firm planned to use another recruiter for its Director of Litigation search. We saw leadership potential in a candidate beyond the role we were recruiting for and put him forward. He earned the director position.

Individual placement outcomes; timelines and compensation vary by search.
